5. PRODUCTS AND SERVICES
5.1 Made-to-Order Nature
All Danystone Designs products are custom-made specifically for you based on your unique measurements and requirements. Most of our products are bespoke creations, not ready-made items. Each piece is crafted with strict quality standards to ensure exceptional results.
5.2 Product Categories
We offer products ranging from affordable to luxury designs. The materials and construction methods vary according to the product category and price point, but all items maintain our high-quality standards.
5.3 Complimentary Veil
Selected products include a complimentary veil. This will be clearly indicated on the product page. Other gown categories do not include a free veil.
5.4 Production Timeline
- Standard production and delivery: Up to 2 months from receipt of measurements
- Rush orders may be available for an additional fee (fees vary based on product category)
- In rare circumstances, additional time may be required due to material availability or unforeseen events
5.5 Measurement Services
You may provide measurements through:
- Self-measurement: Following our measurement guide
- LookSmart Professional Measurement Service: Available at participating locations
- Some LookSmart branches: Measurement service cost covered by Danystone Designs
- Other LookSmart branches: Pay directly to LookSmart and we will reimburse you up to $35 NZD
5.6 Custom Alterations and Design Modifications
- After placing your order and providing measurements, you may request design modifications or style changes before production begins
- Contact us immediately after placing your order to discuss your ideas
- We will assess whether additional costs are necessary and confirm feasibility
- Modifications will be made according to your specifications where technically possible
- Alterations requested after delivery are the customer's responsibility and expense (fees vary based on complexity)
6. PRICING AND PAYMENT
6.1 Currency
All prices are displayed in New Zealand Dollars (NZD) and include GST.
6.2 Payment Methods
We accept:
- Shopify Payments
- Credit cards
- PayPal
- Afterpay (for payment installments)
6.3 Payment Terms
- Standard: Full payment is required when the order is placed
- Deposit Option: Available by arrangement - contact us to discuss deposit payment plans
- First deposit due at order placement
- Remaining balance due before delivery
- Afterpay: Available for eligible orders
- Custom Payment Plans: Contact us to discuss alternative payment arrangements
6.4 Price Accuracy
We strive to ensure all prices are accurate. However, we reserve the right to:

- Refuse or cancel orders placed at incorrect prices

- Rush order fees: Vary based on product category and timeline requirements
- Alteration fees (post-delivery): Vary based on complexity and product category

7. ORDER PROCESS

- Production begins once we receive both payment and your measurements
- Order confirmation does not guarantee acceptance

- The requested customization is technically impossible
- We cannot source required materials
- We suspect fraudulent activity
- Payment cannot be verified
- Any other reasonable business concern arises
7.4 Material Unavailability
If materials become unavailable after you place your order:

- We will offer alternative materials of comparable or superior quality
- We will work with you to ensure the final product meets your satisfaction
- You may cancel your order for a full refund if alternatives are not acceptable
8. CUSTOMER RESPONSIBILITIES
8.1 Accurate Measurements
You are responsible for:
- Providing accurate measurements according to our guidelines
- Ensuring LookSmart measurements (if used) are taken correctly
- Understanding that incorrect measurements may result in fit issues
- Any costs associated with alterations due to incorrect measurements provided by you
8.2 Accurate Information
You must provide:
- Correct shipping address for timely delivery
- Valid contact information (email and phone)
- Accurate payment information
8.3 Inspection Upon Delivery
You must:
- Inspect your product immediately upon delivery
- Record an unboxing video for your protection
- Report any damage or defects within 7 days of delivery
- Review our Return and Refund Policy for full details
8.4 Care and Maintenance
You are responsible for:
- Following all care instructions provided with your garment
- Using professional dry cleaning services only
- Proper storage and handling of your garment
- Any damage occurring after the 7-day inspection period
9. SHIPPING AND DELIVERY
9.1 Shipping Regions
We currently ship to:
- New Zealand
- Australia
9.2 Shipping Costs
We offer free shipping to New Zealand and Australia.
9.3 Delivery Timeframes
- Standard delivery: Up to 2 months from receipt of measurements
- Actual delivery times may vary based on production requirements and shipping conditions
- For destination weddings or time-sensitive events, we strongly recommend ordering well in advance
9.4 Delivery Address
- You must provide a complete and accurate delivery address
- We are not responsible for delays or non-delivery due to incorrect addresses
- You are responsible for ensuring someone is available to receive the delivery
9.5 Risk of Loss
Risk of loss and title for products pass to you upon delivery to the shipping carrier.
10. INTELLECTUAL PROPERTY
10.1 Ownership
All content on our website, including but not limited to:
- Design concepts and patterns
- Product photographs and images
- Text, graphics, logos, and trademarks
- Website layout and functionality
is the exclusive property of DANIEL AND PHILIP LIMITED (Danystone Designs) and is protected by New Zealand and international copyright, trademark, and other intellectual property laws.
10.2 Customer Use
You may:
- View and use our website for personal, non-commercial purposes
- Share photos of your purchased dress on personal social media
- Use product images for personal reference

We maintain strict quality control standards for all products. While materials vary based on product category and price point (from affordable to luxury), every item is crafted with care and attention to detail.

All products are thoroughly inspected before shipping to ensure they meet our quality standards.
11.3 Warranty Limitations
Our warranty covers manufacturing defects and damage during shipping (subject to our Return and Refund Policy). We do not warrant against:

- Fit issues resulting from incorrect measurements provided by the customer
- Body measurement changes between order placement and delivery
- Damage occurring after the 7-day inspection period
12. LIMITATION OF LIABILITY

Our maximum liability for any claim arising from your purchase is limited to the purchase price you paid for the product.

- Body measurement changes after order placement
- Delays caused by force majeure events
- Third-party service failures (shipping carriers, LookSmart, payment processors)
12.3 Force Majeure
We are not responsible for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- Pandemics or public health emergencies
- Supplier issues or material shortages
- Shipping disruptions
- Government actions or regulations
- Labor disputes
- Utility failures or internet outages
13. PRIVACY AND DATA PROTECTION

15. CANCELLATIONS
15.1 Before Production
Orders may be cancelled before production begins (i.e., before measurements are received). Deposits are non-refundable.
15.2 After Production Begins
Once production has started (after measurements are received), orders cannot be cancelled due to the custom nature and high production costs involved.

- LookSmart is an independent third-party measurement service
- Danystone Designs is not responsible for LookSmart's services or measurements
- Reimbursement for LookSmart fees (up to $35 NZD) applies to eligible locations
- LookSmart's own terms and conditions apply to their services
19.2 Payment Processors
- Payments are processed through Shopify Payments and other third-party processors
- These services have their own terms and privacy policies
- We do not store complete credit card information
19.3 Shipping Carriers
- Shipping is handled by third-party carriers
- Carriers' terms and conditions apply to shipping services
- We are not responsible for carrier delays or service failures beyond our control
20. SPECIAL CIRCUMSTANCES
20.1 Destination Weddings
- For destination weddings or time-sensitive events, order well in advance
- Allow extra time for potential delays and any necessary alterations
- We recommend ordering at least 3-4 months before your event
20.2 Rush Orders
- Rush orders may be available subject to production capacity
- Additional fees apply (varies by product category)

- Rush orders are not guaranteed and depend on current workload
20.3 Custom Requests
- We welcome custom design requests and modifications
- Feasibility and additional costs will be assessed on a case-by-case basis
